These Terms of Service ("Terms") govern your access to and use of Kuca, including our website, AI image and video generation tools, accounts, credits, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority where you live, and capable of entering into a binding agreement. If you use the Service for an organization, you represent that you have authority to bind that organization.
You must sign in before submitting a generation request. You must provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account. You may not share, sell, transfer, or use an account to circumvent access, credit, payment, moderation, or usage limits.
Kuca provides access to multiple AI models for text-to-video, image-to-video, text-to-image, image-to-image, and related creative workflows. Models and infrastructure may be operated by third-party providers. Model availability, supported parameters, processing time, credit cost, output quality, and features may change.
AI outputs are probabilistic and may be inaccurate, incomplete, offensive, similar to content generated for others, or unsuitable for your intended use. Kuca does not guarantee that an output will be unique, error-free, available by a particular time, or eligible for copyright, trademark, publicity, or other legal protection. You must review each output before publishing, distributing, or relying on it.
Visitors who are not signed in cannot submit generation requests. Private mode requires an active paid subscription. Without an active paid subscription, including when an account uses free, promotional, or manually granted credits, the account can generate only in public mode and cannot change a generation to private. An account with an active paid subscription may select public or private mode for eligible generations.
A public designation makes the generation eligible to appear on current or future Kuca public surfaces, including galleries, showcase pages, feeds, share pages, search features, or Kuca promotional placements. Kuca is not required to display every public generation, and a generation may be designated public before a user-facing public page is available.
Where a public feature displays generation details, those details may include the generated output, prompt, selected model and settings, task parameters or drafts (including reference-media links), and your profile name or image. Do not use public mode for confidential material or personal information that you are not authorized to disclose.
Private mode means that Kuca will not intentionally list the generation on Kuca's public discovery surfaces. It does not mean that the content is encrypted end-to-end, stored on a dedicated private system, or inaccessible to Kuca and the third-party providers needed to process the request. Files may also remain accessible through previously issued URLs. Do not submit material that requires confidential or immediate-erasure handling.
"Your Content" includes prompts, uploaded images or videos, reference materials, and other content you submit. You retain any rights you already hold in Your Content. As between you and Kuca, and to the extent permitted by applicable law and third-party provider terms, you own the outputs generated for you.
You grant Kuca and our service providers a limited, worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, modify, and display Your Content and outputs as reasonably necessary to operate, secure, support, troubleshoot, and improve the Service, comply with law, and enforce these Terms.
For a public generation, you also grant Kuca a limited, worldwide, non-exclusive, royalty-free license to make the associated public content available, display it, and promote it on Kuca and in materials that promote Kuca. Kuca will stop initiating new public displays after the generation is changed to Private or soft-deleted, but the license continues as needed for reasonable technical retention, cached copies, copies already made by other users or third parties, and promotional materials already produced.
You represent that you have all rights and permissions needed to submit Your Content and generate, use, or publish the resulting output. You are responsible for your instructions and use of generated content, including obtaining required consent from identifiable people and clearing intellectual property, publicity, privacy, and other rights.
You may not use the Service to create, upload, request, distribute, or facilitate content or activity that:
We may automatically or manually review prompts, uploads, and outputs for abuse, safety, support, and service integrity. We may block a generation, remove or restrict content, suspend an account, preserve relevant records, or report conduct when reasonably necessary to protect users, third parties, Kuca, or the public, or to comply with law.
Paid generations consume credits according to the model and settings shown in the Service. Credit prices, supported features, plan limits, and validity periods are displayed at purchase or generation time and may change for future purchases or uses.
Credits are a limited right to use eligible Service features. They have no cash value, are not transferable or resellable, and expire according to the product or grant from which they came:
Expired or unused credits are not refundable or exchangeable for cash except where required by law.
You authorize Kuca's payment provider to charge the payment method you select for the price, currency, and applicable taxes shown at checkout. Monthly and annual subscriptions automatically renew for the same billing interval at the price disclosed for the renewal unless you cancel renewal before the next billing date.
You may cancel renewal through the billing settings. Unless the subscription is cancelled immediately because of a failed or reversed payment, refund, or similar event, paid access remains active until the end of the current billing period. Cancellation does not extend the validity of credits or create a right to a prorated refund.
Except where required by law or expressly stated at purchase, completed purchases and consumed credits are non-refundable. A task that Kuca's systems confirm as failed may receive automatic credit restoration. A cancelled, blocked, or otherwise unfinished task may be reviewed for manual restoration. Restored credits return to their original credit allocation and retain its original expiration date unless Kuca expressly states otherwise. Restoration is not guaranteed where credits were consumed by a completed task.
If a full refund, payment reversal, or chargeback is processed, Kuca may revoke unused credits associated with the payment, end related subscription access, and restrict the account while a payment dispute is investigated. A partial refund may be handled according to the payment provider's result and applicable law.
Kuca and its licensors retain all rights in the Service, including its software, design, branding, documentation, and underlying technology. These Terms grant you only a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. They do not grant you rights to any third-party model, software, or brand.
The Service relies on third-party AI model providers, hosting and storage services, payment processors, analytics providers, authentication providers, communications services, and other vendors. Your use of a model or integration may also be subject to the provider's terms and policies. Kuca does not control third-party model availability, output, retention, or independent data practices.
Deleting a generation in the Service removes it from your active history and marks its task record as deleted. This is a soft deletion. It does not immediately or automatically erase the underlying database record, uploaded source files, generated output files, logs, provider copies, cached copies, or backups.
Soft deletion does not cancel AI processing that has already been submitted. A provider may complete the request, and Kuca may receive or store the resulting output after the item has been removed from active product views.
Previously issued file URLs and copies made by others may continue to work or exist after soft deletion. Kuca may retain records and files for service operation, security, abuse prevention, dispute resolution, accounting, legal obligations, and technical maintenance. You may stop using the Service at any time. We may suspend or terminate access, remove or restrict content, or limit features if you violate these Terms, create legal, payment, or security risk, or if continued operation is no longer commercially or technically feasible. Where appropriate, we may provide notice and an opportunity to appeal by contacting us.
Termination or loss of access does not create a right to a refund, extend credit validity, or require immediate physical deletion of records or files, except where applicable law requires otherwise. Provisions concerning content rights, payment obligations, disclaimers, liability, indemnification, and retained records survive as necessary to give them effect.
To the fullest extent permitted by law, the Service is provided "as is" and "as available." Kuca disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and results. We do not warrant that the Service will be uninterrupted, secure, or free of harmful components, or that generated content will meet your requirements or be lawful for a particular use.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
To the fullest extent permitted by law, Kuca and its affiliates, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business opportunities, credits, or generated content, arising from or related to the Service.
To the fullest extent permitted by law, Kuca's aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of the amount you paid to Kuca for the Service during the 12 months before the event giving rise to the claim or USD 100. These limits do not apply where liability cannot legally be limited.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kuca and its affiliates, personnel, and providers from claims, losses, liabilities, and reasonable expenses arising from Your Content, your use of generated content, your violation of these Terms, or your violation of another person's rights.
We may modify the Service and these Terms as our products, providers, and legal obligations evolve. We will post updated Terms here and update the effective date. If a material change requires additional notice or consent under applicable law, we will provide it before the change takes effect. Continuing to use the Service after updated Terms take effect means you accept them.
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. Kuca may assign these Terms as part of a merger, acquisition, reorganization, financing, or transfer of the Service. These Terms and the Privacy Policy constitute the entire agreement between you and Kuca regarding the Service, except for additional terms presented for a specific feature or purchase.
